Work visa and permanent residency
South Africa rewrote its rules in October 2024. Many guides still online describe the old system. Here is the framework actually in force, category by category.

Choosing the wrong category costs months.
There isn't a single South African work visa, but half a dozen pathways, with very different conditions, durations and processing times. The first decision — which one applies to you — determines everything else in the application.

Which path corresponds to your situation
You have a job offer
Critical skills visa if your occupation is on the official list, otherwise a general work visa. In both cases, 100 points are required.
Your group is transferring you
Intra-group transfer visa: no points test, but a maximum of four years and non-renewable.
You are setting up or taking over a business
Business visa: an investment of 5 million rand from abroad and 60 % South African staff.
You work remotely
Visitor visa for remote work, open since October 2024 to employees of foreign employers, subject to a income requirement.
The points-based system, since 9 October 2024
This is the most important reform of the South African work visa regime for over a decade. Since 9 October 2024, the general work visa and the critical skills visa are based on a points scale. You have to reach 100 points — and otherwise meet all the other usual requirements: police certificate, medical report, and the rest.

Three practical readings of this painting
An occupation on the critical skills list is sufficient in itself. The job offer is marked «mandatory»: this is an entry condition, and the salary level then awards points — in practice, a salary below the lower band makes approval unlikely. Finally, the NQF is the National Qualifications Framework: your Gabonese qualifications are positioned within it by SAQA.
Good news accompanying the reform: the Certificate from the Ministry of Labour, long required for the General Work Visa, has been scrapped. This resident labour market test routinely took a year and was the main bottleneck of the old system. Outdated document lists are still circulating, including on some official websites — beware.
The fastest route, if your job is on the list
The critical skills visa is the flagship route for foreign professionals in shortage occupations. The profession must appear on the list of critical skills published in the Official Journal on 3 October 2023 — no more recent list has been published since. The visa is issued for a duration of up to five years.
The best-represented sectors are IT and digital, engineering in all its forms, finance and accounting, healthcare and education.
Two additional conditions matter as much as the list itself:
- Confirmation by a professional body. The relevant South African professional body must confirm your qualifications and post-qualification experience. When the profession is regulated — engineers, healthcare professionals, chartered accountants — proof of an application for registration is required.
- The SAQA evaluation, with a concession. Your foreign qualifications must be evaluated by SAQA. Since October 2024, it is possible to submit an application with the proof of a pending SAQA application the visa is then issued for twelve months, and then extended to its full duration once the assessment has been obtained. It is a considerable saving of time.
The former option of coming for twelve months to look for a job locally no longer exists. A signed job offer is now required at the time of submission.
Group transfer, business, remote working
The intra-group transfer
For a company seconding an existing employee to its South African subsidiary or branch, this is generally the simplest route: no points test, no labour market test, no SAQA evaluation. The employee must have been employed by the foreign entity for at least six months, and a skills transfer plan to a South African must be provided.
The trap is the duration. This visa is issued for four years maximum and is not renewable. At the end, the person must leave. A transition to another category must be prepared from the first year, not discovered in the fourth. Furthermore, the holder can only work for the employer named on the visa.
The business visa
For an entrepreneur starting or taking over a business, the core requirement has not changed since 2014: a cash investment of 5 million rand from abroad. Added to this is the commitment that At least 60 % staff being either South African or permanent residents, and a letter of recommendation from the Department of Trade and Industry.
A reduction or exemption of the investment is possible in certain sectors deemed to be of national interest. Conversely, three activities are excluded: the import of second-hand vehicles intended for re-export, adult entertainment and the security sector. The visa is issued for three years, renewable, with regular compliance checks.
The remote work visa
Open since October 2024. An employee of an employer foreigner can live in South Africa whilst working remotely. The regulations set a minimum gross income floor of approximately 650,976 R a year, and the visa is issued for more than three months up to three years.
Two caveats. The holder cannot take up South African employment. And a tax registration obligation may arise depending on the length of stay and the applicable double taxation agreement — the visa regulates immigration status, not the tax position.
Short assignments
For a brief technical intervention — installation, commissioning, audit, training — a work authorisation can be attached to a visitor visa, offering in practice up to 90 days of legal work. It cannot be extended beyond the validity of the visitor visa.
The South African definition of «work» is very broad
South African law defines work as any activity normally associated with the conduct of a business, or any activity corresponding to a person's employment or profession — with or without remuneration.
In other words: a visiting executive who volunteers to «lend a hand» with operational tasks on a standard visitor visa is working illegally. And the host company is committing an offence.
Attending business meetings or a board of directors is not, however, considered work and does not require any special authorisation.
Finally, a point that is often misunderstood: a pending application gives no rights. You can only do what your current visa permits. A person present on a visitor visa cannot start employment while their application is being processed.
Partner and children: the crucial point not to be missed
The spouse and children of a work visa holder receive accompanying visitor visas, the validity of which follows that of the main visa.
But this accompanying visa does not allow work or studies. A spouse who wishes to work must obtain their own work visa. Each child of school age must obtain their own study visa. These procedures must be initiated At the same time than that of the parent.
The situation is different for the spouse of a South African citizen or permanent resident: the spousal visa can, in fact, carry a work authorisation.
Routes to permanent residency
Permanent residency falls under two sections of the immigration law. Section 26 targets those who already have a strong connection to the country; Section 27 those who bring a particular value.

Two common traps. First, the intra-group transfer visa do not lead to permanent residency: you first have to switch to another category and start over for five years. Then, «permanent employment» means a contract no end date — a fixed-term contract is not suitable.
The medical and radiological reports are valid for six months, like the police certificates. In the event of a refusal, an internal appeal may be lodged within ten working days.

A March 2026 directive grants applicants whose waiver, long-stay visa or appeal is pending status and travel concessions until 30 June 2027. However, she specifies that these persons may not engage in any activity other than that authorised by their current visa.
